UNDERTAKING BY BIDDERS

 

IMPORTANT NOTICE OF UNDERTAKING BY BIDDERS USING NipeX PORTAL
  • (a) In recognition of the United Nations Convention against Corruption, the principles of the OECD Convention on Combating Bribery of Foreign Public Officials in International Business Transactions which entered into force on February 15, 1999, the Nigerian Independent Corrupt Practices and Other Related Offences Act 2000, the Economic and Financial Crimes Commission Act 2004, the U.S. Foreign Corrupt Practices Act of 1977 (as amended), the UK Bribery Act 2010, and the other public and commercial anti-bribery laws that may apply (collectively referred to as “AntiBribery Laws and Obligations”), each Bidder responding to any bid in the NipeX Portal warrants that it, its Affiliates, directors, employees, or any person acting on its behalf, have not offered, authorized, received, solicited, or accepted, and will not make, offer, authorize, receive, solicit or accept, any payment gift, promise, or other advantage, directly or indirectly, in connection with the bid and the matters resulting therefrom to and fro the use or benefit of any Person, including Public Officials (NNPC Staff inclusive), or their family members, where such payment, gift, promise, or advantage is for the purpose of corruption or to improperly influence the act, decision, or omission of any such Person, or to illegally obtain or retain business or would violate applicable laws, including the Anti-Bribery Laws and Obligations
  • (b) In addition any Bidder, with regard to operations and/or activities under the NipeX Portal, warrants that it, its Affiliates, directors, employees, or any person acting on behalf, have complied, and will comply, with the Anti-Bribery Laws and Obligations applicable to such Party.
  • (c) A breach of the foregoing provisions shall attract automatic disqualification of the offending Bidder from the bid process and blacklisting from further participation in the NipeX portal as well as prosecution of the individuals and Companies involved in the breach under the relevant criminal laws applicable in Nigeria and other relevant jurisdictions.
